TERMS & CONDITIONS

These Terms and Conditions (“Terms”) apply to all services carried out by Uz Pro Construction LTD (“the Company”, “we”, “us”, “our”). By accepting a quotation, making a payment, or permitting works to commence, the client (“you”) agrees to be bound by these Terms.

2. Definitions

Works: All labour and services provided by the Company.

Contract Sum: The total price agreed for the Works.

Completion: Practical completion of the Works, not cosmetic perfection.

Variation: Any change outside the agreed scope.
3. Scope of Works
3.1 The Works shall be carried out strictly in accordance with the agreed quotation, proposal, or scope document.
3.2 We do not provide:
-
Structural engineering design
-
Drainage design or surveys
-
Building Control consultancy
-
Architectural services
Unless explicitly agreed in writing.
3.3 Any assumptions made due to restricted access or concealed areas are at the client’s risk.
4. Quotations & Pricing
4.1 Quotations are valid for 7 days.
4.2 Prices are based on visible conditions only.
4.3 We reserve the right to revise pricing if:

Hidden defects are discovered
-
Existing installations are non-compliant
-
Client information is inaccurate
-
Site access or working hours change
4.4 VAT is excluded unless stated otherwise.
5. Planning Permission & Building Regulations
5.1 The client is solely responsible for obtaining all:
-
Planning permissions
-
Building Regulations approvals
-
Building Control inspections
-
Freeholder, landlord, or managing agent approvals
5.2 We accept no responsibility for:
-
Works carried out without approvals
-
Enforcement action
-
Remedial works required by authorities
5.3 Any delays or additional costs caused by missing approvals will be charged to the client.
6. Existing Conditions & Hidden Defects
6.1 We are not responsible for:
-
Latent defects
-
Pre-existing water damage
-
Structural movement
-
Asbestos or hazardous materials
-
Defective pipework or wiring
6.2 Discovery of such issues constitutes a Variation.
7. Drainage, Sewer & Plumbing Limitation
7.1 Any connection to existing drainage, soil stacks, or sewer systems is undertaken on the assumption that such systems are fit for purpose.
7.2 We are not liable for:

Blockages or backflow
-
Shared or public sewer failures
-
Flooding due to existing system defects
-
Non-compliant historic installations
7.3 Drainage surveys, testing, or upgrades are excluded unless agreed in writing.
8. Materials & Finishes
8.1 Tiles and materials may vary slightly in shade, size, or finish.
8.2 We are not responsible for:
-
Manufacturer defects
-
Client-supplied materials
-
Delays caused by material shortages
8.3 Tile layouts and grout lines are subject to practical tolerances.
9. Tile & Surface Limitations
9.1 Tile lippage, grout width variations, and cuts are inherent to tiling work.
9.2 We are not responsible for:
-
Movement cracks
-
Substrate failure
-
Surface irregularities outside industry tolerances
9.3 Waterproofing is limited to areas specified in the scope.
10. Programme & Delays
10.1 Timeframes are estimates, not guarantees.
10.2 Delays may occur due to:
-
Weather
-
Material supply
-
Third-party trades
-
Client changes
No compensation is payable for delays.
11. Client Responsibilities
The client must:

Provide uninterrupted access
-
Ensure utilities are available
-
Secure valuables
-
Disclose known issues
Failure may result in delays or additional charges.
12. Variations & Additional Works
12.1 All variations are chargeable.
12.2 Verbal instructions are binding once work is carried out.
13. Payments
13.1 Payment terms are stated on the invoice or proposal.
13.2 Late payments may result in:

Suspension of works
-
Interest charges
-
Recovery costs
13.3 Ownership of materials remains with us until paid in full.
14. Suspension & Termination
14.1 We may suspend works for non-payment or unsafe conditions.
14.2 The client remains liable for work completed to date.
15. Workmanship Warranty (24 Months – Limited)
15.1 We provide a 24-month workmanship warranty covering defects solely caused by our workmanship.
15.2 The warranty does not cover:

Materials
-
Appliances
-
Sealants (silicone, grout maintenance)
-
Wear and tear
-
Movement, settlement, or vibration
-
Water pressure issues
-
Blockages or drainage issues
-
Misuse or lack of maintenance
-
Third-party works or alterations
-
Consequential damage
15.3 The warranty is valid only if:
-
Full payment has been made
-
The installation has not been altered
-
Maintenance instructions have been followed
15.4 Our liability is limited to repair, not replacement or compensation.
16. Insurance & Liability Cap
16.1 We carry appropriate public liability insurance.
16.2 Our total liability is limited to the contract value.
17. Indirect & Consequential Loss
We are not liable for:

Loss of use
-
Loss of earnings
-
Alternative accommodation
-
Business interruption
18. Force Majeure
We are not responsible for events beyond our control.
19. Complaints
Issues must be reported promptly to allow rectification.
20. Website Use & Intellectual Property
All content is protected.
21. Data Protection
Handled in accordance with UK GDPR.
22. Governing Law
England & Wales.
23. Entire Agreement
These Terms form the entire agreement and override prior discussions.
24. Amendments
We may update these Terms at any time.
